Gathering and storage of personal data, including terms and purpose of use

Personal data is detailed information regarding the personal and material characteristics relating to an identified or identifiable individual, and so covers all data which can be collected about you. In the following paragraphs we will illustrate which personal data we gather and use.

Surfing our website and using our apps

When you visit our website or use our apps, the browser used by your device will automatically send information to our website’s server.

This information will be temporarily stored on a Logfile. Logfiles record enquiries and visits made by individuals accessing our website, as well as unsuccessful attempts to access a webpage. The following data is collected and stored before being automatically deleted:

  • IP addresses of the requesting device;
  • Date and time of access;
  • Name and URL of the requested file;
  • The website from which you were referred (Referrer URL);
  • The browser and operating system used by your device, as well as the name of the provider.

The collection of data for provision of the website and the storage of data in logfiles is essential for the website provider. Therefore, it is not open to contention by the user.

The following information is stored when you access our website:

  • Travel preferences and activities;
  • Information regarding your surfing behaviour on our website and the use of our apps;
  • Information regarding when you click on our advertisements or other elements, including those displayed on or linked to the websites of other organisations;

  • Social preferences and general interests and activities.

Together with other personal data, this user data is not stored when the user is merely browsing.

If you contact or are contacted by us, or if you engage with an advertising campaign or survey, then we collect the following data:

  • Travel preferences and activities;
  • Information regarding your surfing behaviour on our website and the use of our apps;

If you request and/or buy our holidays and products and/or create an account with us, then we may collect any of the following data:

  • Travel preferences and activities;

  • Information about your purchases, for example what you have bought, where and when you bought it, how you paid, as well as credit and other payment information;
  • Your booking details such as travel destination and itinerary;
  • Information regarding those travelling, including passport details and other ID information;
  • Insurance details;
  • Relevant medial data, as well as possible specific dietary requirements or other requirements due to religious reasons or physical impairment;
  • Usernames and your encrypted password, so that we may protect your account;
  • Should you be presented with the option to log in using log-in details from a social media account, such as Facebook, we will obtain neither your password nor other log-in details for these accounts. Without your consent, we will not post anything on your social network feeds or to your friends, followers or contacts.

Other sources of personal data:

  • We can use personal data from other sources, for example from businesses, which provide information and data, business partners, service providers, as well as from public registers.
  • Your insurance company, whose representatives and medical employees may share with us relevant personal data and specific categories of personal data, with the understanding that we/they must only use them on your behalf or in the interest of other customers or in a case of emergency.
  • When you log in using log-in details from a social network account, thereby connecting our platform and online services such as Facebook, Google+ or Twitter, you thereby consent to sharing your data with us. For example, your name, your E-Mail address, your date of birth, your location and other information which you would like to share with us. Without your consent we will not post anything to your social media feeds or to your friends, followers or contacts.
  • Your exact location is not determinable by your IP address. However, it is possible to share your location with us via social media or explicitly through the corresponding functions of the website.
  • Information which is made available by other users: occasionally, other website visitors or app users give information about you. If our website or app users would like to invite you to use our website or app, or if they would like to share information regarding our service or offers, we will use the personal data shared about you to support these users. However, we only do this if the user has stated that they have already agreed this communication with you.

Personal data you share with us regarding other persons

  • We use data you share with us regarding other persons, e.g. other travellers.
  • When sharing personal data regarding other persons, you must make sure to seek their approval for the sharing of their data. Where possible, you should also make sure that these people are aware of the ways in which we could use their data.

Justification for the gathering of data

The aforementioned gathering of data is based on Art. 6(1) Para. 1 Pg.1 (f)  GDPR. In accordance with Art. 6(1) Para. 1 Pg.1 (f)  GDPR, the processing of data to safeguard legitimate interests is allowed, provided this does not violate the interests, fundamental rights or fundamental liberties of the persons whose personal data requires protection.

In addition, data collection takes place on the basis of your voluntarily granted consent, according to Art. 6(1) Para. 1 Pg.1 (b) GDPR for the execution of pre-contractual measures, which takes place at your request and according to Art. 6(1) Para. 1 Pg.1 (f)  GDPR.


Using your personal data

The aforementioned data will be used for the following purposes:

  • To ensure the smooth running of the travel agency and of the travel itinerary;
  • To process payments;
  • To give insurance cover;
  • To fulfil legal requirements;
  • To ensure a stable connection to our website;
  • To ensure system security and stability;
  • To ensure a comfortable, inspiring and tailored website experience;
  • To continually improve and manage the use of our website and apps, as well as customer loyalty, our customer recognition engine and other such services;

  • To further develop and improve our product catalogue, services, shops and IT systems, as well as our security provisions, our knowledge and methods of communication with customers;
  • To show and send you travel suggestions and offers through relevant direct marketing which meet your interests;

  • To optimise and manage advertisements and advertisement campaigns, so that the experience is ideal for you;
  • To prevent abuse of contact forms and to ensure the security of our information system;
  • To react to and advise you security issues, disruptions or other such incidents, which could be of medical nature or involve your insurance;
  • To optimally manage, design and continually improve billing transactions on either internal or external interfaces;
  • To better understand you as a customer and thus provide you with services and communication which benefit you;
  • To meet legal requirements, such as in the case of government enquiries or criminal justice authorities which carry out investigations.

Our legitimate interest results from the above purposes. We do not used data gathered from your browser to make conclusions about the character of any persons visiting our website.

Moreover, through taking relevant measures and carrying out regular controls, we ensure that the data gathered by us cannot be seen or extracted by third parties.

Marketing activities with your consent

From time to time we would like to send you offers and newsletters regarding our products and services via different platforms, such as by E-Mail, Messenger or telephone. We would also like to send you information about products and services from other companies or partner companies which we think you would find interesting.

When you book or register with us, we will ask you if you would like to receive our marketing communications. We only verify the contact details you send online once. Therefore, we ask you to confirm your details twice, such as when signing up for E-Mail marketing.  You will only receive our marketing communications once you have activated the link we sent to you via email.

We will only do this once you have confirmed that you agree to receive our marketing communications.

Consent can only be given by persons older than 16 years of age. When you give consent, we assume that the applicant is over 16 years of age, or that they have the consent of a parent or legal guardian.

You can completely or partially revoke your permission. Should you no longer wish to receive advertisements, you must only let us know. Naturally, the choice is yours. Nevertheless, by stating that you do not wish to receive any marketing information, you will be missing out on great offers.

You could still receive service-related communications from us. These could take the form of booking confirmations, as well as important information regarding the use of our products and services.

E-mail advertising with newsletter registration

If you subscribe to our newsletter, we will use the data required for this purpose or provided separately by you in order to send you our e-mail newsletter regularly on the basis of your consent pursuant to Art. 6 Para. 1 S. 1 lit. a DSGVO. 
You can unsubscribe from the newsletter at any time and either by sending a message to the contact person described below or via a link in the newsletter provided for this purpose. After you have unsubscribed, we will delete your e-mail address from the mailing list unless you have expressly consented to further use of your data or we reserve the right to use data beyond this, which is permitted by law and about which we will inform you in this declaration.

E-mail advertising without registration for the newsletter and your right of objection 

If we receive your e-mail address in connection with the sale of a product or service and you have not objected to this, we reserve the right to send you regular offers for similar products to those already purchased from our range by e-mail on the basis of § 7 para. 3 UWG. This serves to protect our predominantly legitimate interests in an advertising approach to our customers within the framework of a weighing of interests. 

You can object to this use of your e-mail address at any time by sending a message to the contact option described below or via a link provided for this purpose in the advertising mail without incurring any costs other than the transmission costs according to the basic tariffs.

Personalisation of the browsing experience

We aim to ensure that marketing communications (as well as online advertisements) – in addition to our products and services and those of our partner companies, suppliers and business partners – are tailored to your interests.

To do this, we use the automatically generated personal data shared by you to get to know your interests, so that we may predict which products, services and information might interest you the most. This then allows us to tailor our communications to make them more relevant for you. To this end, we use the shared information, such as: acknowledgements of receipt and opening of emails; information about your computer and internet, operating system and platform connection; your order history; service history; date and time of your visit to our website; and products you have viewed. This analysis and evaluation helps us to better understand you as a customer and allows us to offer you personalised products and services. Our aim is to make your advertisements, offers and travel suggestions more helpful and interesting, which means offering you products and services which better meet your expectations as a customer.


During visits to our website, we use the SSL method (Secure Socket Layer) together with the respective encryption methods used by your browser. Normally a 256 Bit encryption is used. Should your browser not support a 256 Bit encryption, then we revert to 128 Bit v3 technology. You can find out whether an individual page of our website has been transmitted in encrypted form by checking as to whether the key or padlock symbol in the status bar of your browser is in a locked position.

Additionally, we apply appropriate technical and organisational methods to protect your data from accidental or intentional manipulations, partial or complete loss or damage and against unauthorised access of third parties. Our security measures are continually being improved and maintained in line with technological developments.

We would point out that the data transmission on the internet (for example with communication via unencrypted E-Mail) may involve security risks. Complete protection of data from the access of third parties is thus not possible.

Deleting data

We only keep your personal data for so long as is necessary for the purposes stipulated in this data protection statement and/or to comply with legal retention obligations. After this period, we securely delete personal data. Should data be needed following this period for analytic, historic or other legitimate business purposes, we will take the appropriate measures to anonymise this data.

Updating your data and right to objection

If your personal data has been processed based on legitimate interests in accordance with Art. 6(1) Para. 1 Pg.1 (f)  GDPR, then you have the right, in accordance with Article 21 of the GDPR, to object to the processing of your personal data, insofar as there are reasons relating to your specific situation or to objection to targeted advertising.

In the latter case, you have a general right to objection which does not require a justification for it to be implemented.

Passing on personal data

To suppliers and business partners

To provide you with your desired products and services, we must share personal data regarding your travel service with providers and business partners, which include: airlines, hotels, tour operators, car rentals, destination agencies, travel insurance companies and the relevant travel agencies and intermediaries.

We only share the minimum personal data necessary to allow our suppliers and business partners to produce services for us and for you.

To authorities and other legal parties

We may have to pass on your personal data to comply with our legal duties and to uphold justice. This is especially the case with legal obligations regarding the protection of assets or ensuring security.

For you to be able to travel, it is obligatory (legally required by the authorities of your respective place of departure and/or destination) to disclose and process your personal data for the purposes of immigration, border control, security and the fight against terrorism or other appropriate purposes.

Some countries will only issue travel permits if your passenger details are made available (for example Caricom API-Daten and US Secure Flight Data). These conditions can differ depending on the destination country. We recommend that you check individual requirements.

We must fulfil these requirements for your trip to proceed smoothly.

Inside of the Fit Reisen Group

We may exchange personal data within the Fit Reisen Group. This includes subsidiary companies (organisations under our domain or control) or parent companies (organisations which have us under their domain or control) as well as their other subsidiary companies.

Passing on personal data enables us to work together to optimise the customer experience. We try to keep the scale of the sharing of data as minimal as possible to achieve this aim.

To company buyers or partner companies

Personal data may be passed onto buyers or potential buyers of our company, our subsidiary companies, our parent companies and their subsidiary companies, as well as the assets of these subsidiaries. In the case of potential buyers of our company, this information is only ever passed on in an anonymised form.

To Service Providers, Advisers and in Cases of Exposing Criminal Activities

We give personal data to third parties who provide services for us. For example, external service providers may help us with: supporting IT infrastructure; processing payments on our behalf; providing analytical information for us regarding our products, services and marketing; performing professional services in data storage and connection; marketing; market research; processing of payment transactions; and providing products and services. These third parties have access to your personal data only under our instruction and are obliged to protect your data. In some cases, such service providers gather data as independent data processors (Responsible Authorities), to comply with their own respective contractual obligations, for example with certain payment methods or processing your payment.

When we share personal data with other organisations, we demand of them that they safely store this data. They are not permitted to use this data for their own marketing purposes.

In the terms specified by the contract, we only give your personal data to third parties when:

  • You have given explicit consent in accordance with Art. 6 Para. 1 Pg.1 (a) GDPR;
  • Giving this information is necessary for the purposes of the legal assertion, exercise or defence of legal claims in accordance with Art. 6(1) Para. 1 Pg.1 (f)  GDPR, and that there is no reason to suppose that you have an overriding interest warranting protection relating to the nondisclosure of your data;
  • There is a legal obligation to pass on this data in accordance with Art. 6 Para.1 Pg.1 (c) GDPR;
  • This is legally permitted and necessary for the settlement of the terms and conditions of the contract in accordance with Art. 6 Para. 1Pg. 1 lit. b GDPR;
  • We may do so on the permission of a legitimate interest or other such authority.

International Transmission of your Personal Data

Every piece of personal data we obtain can be transferred to and stored in countries outside of your country of residence. Data can be transferred outside of the EEA mainly so that our employees and partners in these countries may have access to this data. When you book a holiday for a destination outside of the EEA, your data will be shared to the relevant hotel and/or flight operators in this destination country, as well as with further service providers and possibly intermediaries and trade partners. Some of these countries offer differing levels of protection when it comes to personal data and, in some cases, this can mean less protection than the country in which you are resident. We take the relevant measures to ensure that your personal data is treated securely and in accordance with the applicable legislation and data protection directive. When data is transmitted outside of the EEA and is intended for stakeholders, service providers, buyers or sellers in a country in which there is no available EU Commission Adequacy Decision, then this data is adequately protected by that of the standard contractual clauses approved by the EU Commission, a corresponding Privacy Shield certification or the corporate regulations that are binding on the data-processing body are sufficiently protected.

The tracking measures listed below and used by us are based on Art. 6 para. 1 Pg. 1 lit. f GDPR. With the tracking measures to be used, we want to ensure a needs-based design and the continuous optimisation of our website. Google Analytics

We use Google Analytics, a web analytics service from Google in ( (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland) for the design and continuous optimization of our pages. In this context, pseudonymised usage profiles are created and cookies are used (see under para. 4). The information generated by the cookie about your use of this website, such as

Google AdWords Conversion Tracking

We also use Google AdWords Conversion Tracking to statistically record the use of our website and to evaluate it for optimising our website. AdWords is an online advertising program of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). Google AdWords will set a cookie on your computer if you have reached our website via a Google ad.

These cookies expire after 30 days and are not intended for personal identification. If the user visits certain pages of the AdWords customer's website and the cookie has not yet expired, Google and the customer can see that the user clicked on the ad and was redirected to that page.

Each AdWords customer receives a different cookie. This means that cookies cannot be tracked through the AdWords customer's web pages. The information obtained using the conversion cookie is used to create conversion statistics for AdWords customers who have opted for conversion tracking. AdWords customers will see the total number of users who clicked on your ad and were redirected to a conversion tracking tag page. However, you do not receive any information that allows users to identify themselves personally.

The storage of "conversion cookies" is based on Art. 6 para. 1 (f) DSGVO. The website operator has a legitimate interest in analysing user behaviour in order to optimize both its website and its advertising.

Your Data Subject Rights

 You have the right:
